Can any consumer distribute/ resell electricity supply?

Definition

A consumer cannot distribute/resell electricity supply to other people in part or whole. Sellers of electric energy must have a license to distribute energy from the electricity commission. many a case we see a consumer sell electricity to his neighbor through a sub-meter. It is illegal to sell energy to other domestic premises.

in case of commercial connection of office or residential complexes where the connection is released in name of the builder. who sells each shop/ apartment to individuals one by one by retaining the balance for lease. A builder may supply an individual in the following way-

  1. The builder would take a connection in his name and instructed the individual owner of the flat to install a sub-meter, based on consumption of individual sub-meter, Bill would be generated with the same rate decided by the regulatory commission, and all amount collected will give back to the builder.
  2. Builder can permit society and association of apartment/complex to take connection in name of society. Now society will instruct the individual owner of the flat to install a sub-meter, based on consumption of individual sub-meter, Bill would be generated with the same rate decided by the regulatory commission, and all amount collected will give back to the builder.

As per electricity supply code 2005-

All new connections to domestic/non – domestic Multistoried Buildings / Multiplex / Marriage Halls / Colonies shall be released only on multiple points for supply of power to individual owners/occupants from the electricity department.

The role of the development authority shall be limited to the development of electrical infrastructure necessary to make available electricity supply to individual connections from the system of the distribution licensee. Accordingly, in the initial phase, the developer/development authority shall seek a temporary connection from the licensee for developing the electrical infrastructure. Once, the electrical infrastructure is developed, the developer shall hand over the same including bus bar and other central equipment to the licensee, which shall remain under the control of the licensee. Upon successful completion and handing over the electrical infrastructure to the licensee, all occupiers/consumers shall apply to the licensee for individual connections whereas, the developer / RWA shall apply for separate connections (s) for common facilities
