How to calculate electricity theft penalty

When a person is caught in an electricity theft crime. The electricity department imposes a penalty. Penalty consist of two-part-

1- Summon shulk also called compounding 

2- Assessment

Summon shulk / compounding- Compounding is court fees against crime done. Which is varies according to the type of supply use. Means its amount will be different for domestic use, commercial use, and industrial use. 

Assessment- This is the cost of energy used by the culprit during the theft of supply. Or we can say it is an electricity bill in the period of theft. Since it is named as a penalty so calculated bill for the period of theft is multiplied by two.

If any culprit who does electricity theft, have a prior connection and caught in meter bypass, intentionally meter tamper, cable cut before meter like theft case then assessment part calculation will be as follow-

First of all, we calculate the assessed unit(kwh) or energy consumed then that unit shall be multiplied by tariff rate-

 Units Assessed = L * H * F * D. 

Where

L = is stood for the connected load in kW and KVA 

H = is the average supply hour given to consumers and it varies according to the categories of supply- 

a) for Agriculture use of supply and Single shift industry (Day or night shift), “H’’ shall be- 10 hrs 

 b) for commercial use of supply “H’’ shall be- 20 hrs

 c) Continuous process industry like rice mill H shall be -24 hrs 

 d) for domestic type use of supply “H’’ shall be- 18 hrs

 e) for Temporary connections type of use of supply “H’’ shall be- 12 hrs

 D = according to satisfactory evidence no of actual days of use of electricity. SDO and JE shall investigate the actual days of use of electricity.

 If days are not clear then-

In the case of domestic or agriculture consumers, D = 90 days

And all other consumers/ commercial= 180 days 

F = connected load factor/diversity factor for different types of supply as given below: 

a) For domestic light and fan consumers F will be = 0.30 

b) For non-domestic and commercial consumers F will be = 0.50 

c) small industrial power consumers F will be = 0.50 

d) For hv2 or large and heavy power consumers F will be = 0.75 

e) for Agriculture consumer F=0.30 

f) all other Categories consumer not covered in above list F will be = 0.50 

2. using the above formula assessed unit shall be calculated and that assessed unit shall be charged at two (2) times the rate of the applicable tariff of the used category. After calculation of assessment using the above formula bill amount paid by the consumer for the assessment, the period shall also be deducted.

Example - Penalty for theft in Domestic Category

for domestic (rural) type use 1 kw theft (already connection but did bypass of the meter)

Assessed unit = L*H* F* D

Load= 1 kw     

Hour h= 18 hour

Factor= 0.3 

Days= 365 (it can be change if evidence of actual days of use is available)

Assessed unit= 1*18*0.3*365 = 1971 unit (kwh)

Electricity charge (EC) = unit assessed *tariff = 1971* 3.3 = 6505 Rupees

Fixed charge= load* fix charge rate= 1*90=90*12 month=1080 Rupees

Electricity duty = (6505+1080)* 5%= 380 Rupees 

Total Assessment= 6505+ 1080+ 380 = 7965

Since total assessment shall be two times calculated assessment as penalty = 7965*2= 15930 rupees.

Summon shulk = for 1 kw domestic connection summon shulk/ compounding= 2000/kw= 2000 rupees

The total amount that has to be paid by the culprit against electricity theft shall be= 15930 +2000= 17930.

Example - Penalty for theft in Commercial Category

For commercial type use 1 kw theft (already connection but did bypass of a meter)

Assessed unit = L*H* F* D

Load= 1 kw     

Hour h= 18 hour

Factor= 0.5

Days= 365 (it can be change if evidence of actual days of use is available)

Assessed unit= 1*18*0.5*365 = 3285 unit (kwh)

Electricity charge (EC) = unit assessed *tariff = 3285*5 = 16425 Rupees

Fixed charge= load* fix charge rate= 1*110=110*12 month=1320 Rupees

Electricity duty = (16425+1320)* 5%= 887 Rupees 

Total Assessment= 16425+ 1320+ 887 = 18632

Since total assessment shall be two times of calculated assessment as penalty = 18632*2= 37264 Rupees.

Summon shulk = for 1 kw domestic connection summon shulk/ compounding= 2000/kw= 2000 Rupees

The total amount that has to be paid by the culprit against electricity theft shall be= 37264 +5000= 42264.

So, Whenever a person is caught in electricity theft. So the penalty levied mainly depends on the type, load, and category of electricity theft. As mentioned above, there are two parts (assessment and summons fee) in the electricity penalty.

Types of electricity theft-

There are many ways by which a person can a involve in electricity theft. Those type of theft are as follow-

1- Direct Theft (no prior connection possess by culprit)

2- Meter By-Pass (by using an extra cable by cutting the main cable before the meter)

3- Meter Tamper

4- by shunting within meters

5- When using industrial and commercial connections from domestic connections (if the connected load is more than 5 kW).

6 - Use of commercial and industrial connections from agricultural connections (if the connected load is more than 5 kW)

The culprit can be jailed for up to 3 years for electricity theft. If the summon fee and assessment amount is deposited by the person, then the power theft case will automatically end.

Hearing in Assessment/ Penalty -

If any guilty is not satisfied with the assessment made by the Electricity Department, then that person can present his case by giving his representation in the office of the Executive Engineer. The provisional assessment made by the electricity department is generally made for 365 days. But if the accused is successful in proving that by showing any evidence that electricity is being used by him for a short period. then their assessment will be modified. If the accused still feels that his assessment has been made wrong, then the accused can appeal to the Superintending Engineer's office above the Executive Engineer. and may change the assessment. Therefore, one can go to the assessment but no change can be made in the summon fee. Because summon fee is considered a court fee.

    provisionally assemnt notice from electrical department, for meter bypass on domestic permisses,
    They put load found 1.5 kVA, load factor 0.85 and day’s 365,
    But if I put your calculations logic 0n domestic permisses for meter bypass for load found 1.5 kVA
    L×H×F×D= assessment bill will be around 25000 rs,but
    Department send me 96000 rs bill, so I want I calcification.

      ENERGY CHARGE= UNIT CONSUMED* UNIT RATE
      PENALTY =2* ENERGY CHARGE

      SO PENALTY/ASSESSMENT WILL BE TWO TIMES OF ENERGY CHARGE
      ELECTRICITY DUTY OT TAX ALSO WILL BE CHARGED

    Domestic rural unmetered connection
    They told us that 5kwh is being used in our house
    They have put a case on use
    How much will be the penalty sir ???

  3. These is one bill in the name of 2 person but I did not do illegal activities but they charged 96 thousand both person but one person accepted, for the few times I took line from his meter. He ready to pay settlement amount Rs. 68000 inspite of this they send me a notice from local police station.at the time hearing they could not show me any evidence, said we could not take pictures or video.
    Now in letter mentioned that you both are jointly involved as per there observation.
    Please suggest.

  4. I have house and was paying my electricity bill on time , I was trying to re-construct my house using the same connection. But some of the electricity official came to site and cut my electricity supply without giving me proper notice or any guidance on what can be done.

    They after few days suggested me to
    – pay fine,
    – Do permanent disconnection
    – Apply for temp connection for house reconstruction
    – remove temporary connection
    – apply for new connection

    This looks to be a very long process can you please guide me with what can be done. Based of documents of UP electricity board domestic connection can be used for house re-construction case. Please look into the matter .
